1. Scope of Application

Our online shop is intended exclusively for business customers. In addition to verifying your business status during the ordering process, we may request proof such as a commercial register excerpt or business registration. These terms also apply to future business relationships without further reference. If the customer uses conflicting or supplementary terms, their validity is expressly rejected unless we have agreed otherwise in writing.

2. Contractual Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with All-in-Gas GmbH.

By listing the products in the online shop, we issue a binding offer to conclude a contract for these items. You can initially place products in the shopping cart without obligation and correct your entries at any time before submitting your binding order using the correction tools provided during the ordering process. The contract is concluded when you accept the offer by clicking the order button. Immediately after submitting the order, you will receive a confirmation email.

3. Contract Language, Storage of Contract Text

The languages available for contract conclusion are German and English. We store the contract text and send you the order details and these terms in text form. For security reasons, the contract text is no longer accessible via the internet.

4. Subject of the Contract

4.1 Product Description

The validity of the product description as an essential component of the contract is emphasized.

4.2 Product Images

Without prejudice to your statutory warranty rights, we note that screen configurations (e.g., resolution and brightness) may cause slight deviations between displayed and actual product colors. If in doubt, please contact us.

5. Delivery Terms

We ship products to the delivery address provided during ordering.

Delivery is by shipping only; self-collection is not possible.

We do not ship to parcel lockers.

6. Reservation of Partial Delivery

Subject to self-supply, we aim for prompt delivery. If part of your order is unavailable due to delayed supplier delivery without our fault, we will ship the remaining items – without additional shipping costs – as soon as they become available, provided this is reasonable for you.

7. Payment

7.1 Prices

The prices stated at the time of ordering apply. These are all-inclusive prices including statutory VAT.

7.2 Due Date and Default of Payment

The price is due upon contract conclusion unless otherwise stated. In case of default, we reserve the right to charge statutory default interest of 9 % above the base rate, plus a €40 flat fee. Additional claims remain unaffected.

7.3 Payment Methods and Invoicing

You agree to receive invoices via email; this consent can be revoked anytime.

Available payment methods: Advance payment: we will provide our bank details separately and ship after payment.

Credit Card: provided during checkout; charged immediately.

PayPal: requires a PayPal account for payment processing at the time of order.

Invoice: payable 14 days after invoice and delivery, subject to credit check. Set-off or retention rights only apply for claims from the same contract.

8. Retention of Title

We retain ownership of the goods until all claims from the business relationship are satisfied. You may resell the reserved goods in the ordinary course of business; any resulting claims are assigned to us in advance to the amount of the invoice. You remain authorized to collect them, but we may collect them ourselves if payment obligations are not met.
If you process or combine reserved goods with other items, we acquire co-ownership in proportion to the invoice value. We will release collateral if its realizable value exceeds secured claims by more than 10 %.

9. Transport Damages

The risk of accidental loss or damage transfers to you once the item is handed over to the carrier, freight forwarder, or other designated party.

10. Warranty and Guarantees

10.1 Statutory Warranty Rights

Except as expressly agreed, statutory liability for defects applies.
The following limitations and shortened deadlines do not apply to claims for damages due to injury to life, body, or health, gross negligence, intent, cardinal obligations, guarantee promises, or where product liability law applies.

Limitations for business customers: only our own statements and manufacturer product descriptions are contractually binding; other public statements are excluded. Warranty claims for new goods expire one year after risk transfer (except for building materials). Statutory recourse periods under §445a BGB remain.

Rules for merchants: merchants must inspect goods and report defects per §377 HGB; failing to do so is deemed acceptance unless defects were hidden or we fraudulently concealed them.

10.2 Guarantees and Customer Service

Information on additional guarantees and conditions can be found on product pages or special information pages in the online shop.

11. Liability

We are fully liable for damages resulting from injury to life, body, or health, intentional or grossly negligent breaches, guarantee promises, or under product liability law.
For slight negligence concerning cardinal obligations, liability is limited to foreseeable damages at contract conclusion. Otherwise, liability is excluded.

12. Agreement on the Use of Trusted Shops Buyer Protection

You can secure orders up to €100 free of charge via Trusted Shops SE buyer protection. Paid protection is available above this amount according to Trusted Shops terms found here. Buyer protection is activated via the Trustbadge on the order confirmation page. Once registered, orders are automatically protected. To provide this, the Trustbadge accesses the email hash, order number, and total. Data is transmitted securely.

13. Final Provisions

German law applies, excluding the UN Sales Convention. For merchants, public-law entities, or special public funds, the exclusive venue is our place of business.
